Effective date: July 13, 2026.
1. Contracting party
These Terms are an agreement between you and Unicorn Applications LLC (“Unicorn Applications,” “we,” “us,” or “our”). USA Ag Data is a product of Unicorn Applications LLC and is not a separate legal entity.
2. Eligibility and authority
You must be at least 18 years old and able to form a binding contract. If you act for an organization, you represent that you have authority to bind it.
3. Service and availability
USA Ag Data provides tools for selecting and licensing agricultural prospect data. During prelaunch, counts, samples, checkout, and downloads may be unavailable. We may change, suspend, or discontinue features and may reject orders that do not pass compliance or availability checks.
4. Orders, payment, and delivery
Prices are shown before payment. Orders are not final until payment is confirmed. Delivery timing depends on segment size, validation, suppression checks, and system availability. Taxes may apply. Refunds are handled under the checkout terms and applicable law.
5. Data license and acceptable use
Purchased data is licensed, not sold, and is governed by the Data License and Acceptable Use Policy, both incorporated into these Terms. You are responsible for your outreach, legal basis, notices, suppression lists, and compliance with all laws and platform rules.
6. No regulated eligibility use
The service is not a consumer reporting agency and data may not be used for credit, employment, housing, tenant screening, insurance eligibility or underwriting, or any purpose governed by the Fair Credit Reporting Act or similar eligibility laws.
7. Accounts and secure links
Buyers use secure emailed order links. Keep links confidential and notify us promptly of suspected misuse. Administrative access is restricted and separately authenticated.
8. Disclaimers
Data can become stale, incomplete, or inaccurate. Except where prohibited by law, the service is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, noninfringement, or uninterrupted availability.
9. Limitation of liability
To the maximum extent permitted by law, Unicorn Applications LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits or data. Our aggregate liability relating to a paid order will not exceed the amount paid for that order during the preceding twelve months.
10. Indemnity
You agree to defend and indemnify Unicorn Applications LLC against claims arising from your outreach, use of licensed data, violation of law, or breach of these Terms or incorporated policies.
11. Changes and contact
We may update these Terms prospectively. Material changes will be posted with a revised effective date. Contact support@usaagdata.com with questions.
